Sample Giveaway Campaign for all Operators- Terms and Conditions
1. These Terms and Conditions (hereinafter ”TnCs”) published on 20th Oct 2024 shall govern the “Sample Giveaway Campaign” (hereinafter referred to as “Promotion”) and shall be applicable to you to the extent law permits, hence read them carefully.
2. Eligibility: This Promotion is open to the validated business operators, their authorized representatives including chefs and managers based out of United Kingdom and Ireland, aged 18 or over, except employees of the Promoter, their families, agents, or anyone professionally connected with the Promotion. It has been clarified that a validate business operation is where the business address can be validated via Cateryst.
3. Promotion Period: The Promotion Period starts from 6:00 BST on 28th September 2024 and except otherwise notified in writing of any extension, the closing date for the receipt of entries in the Promotion shall close on 6:00 GMT on 30th November 2024.
4. Prize: Subject to the Selection Process defined below, there shall be redemption of one sample as the winner, who will receive the following as a Prize:
a. 1x 2L Hellmann’s Vegan Mayonnaise; and
b. Product Information leaflet(s).
5. Entry Mechanism: Subject to the terms and conditions herein mentioned, to participate in the Promotion, the entrant must visit https://www.unileverfoodsolutions.co.uk/about-our-brands/hellmanns-vegan-sampling-campaign-booker.html and fill out the sample request form specifying their email, name, job title, post code, business address, sector and preferred wholesaler etc.
6. Limitations to the Promotion:
a. This Promotion is limited to one entry per validated business operation. The entrant must be working within a validated business operation.
b. If any group of people elects to collaborate on a submission, then they are required to designate an elected person to represent as the agent of the group and to participate in the Promotion. It is clarified that acceptance to these TnCs will be acceptance on behalf of the group.
c. No applications from agents, third parties, organized groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Any entrant found to be using multiple Instagram accounts to enter will be ineligible. Entries will only be accepted if they comply with all these Terms and Conditions.
d. Responsibility is not accepted for entries lost, damaged, or delayed as a result of any network, computer hardware or software failure of any kind.
e. By participating in this Promotion, you agree to release, discharge, and hold us harmless from any and all injuries, liability, losses and damages of any kind resulting from your participation in this Promotion (save that nothing shall limit our liability for fraud, or for death or personal injury caused by our negligence).
f. By submitting your entry for this Promotion, you grant us a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable and transferrable license to use, reproduce, distribute and make derivative works of your entry in any media and through any media channel.
g. Entrants shall defend, indemnify and hold the Promoter and their respective affiliates, directors, agents, or other partners ("the Indemnitees") harmless from any claims, actions, proceedings, costs (including reasonable legal fees) and expenses brought or asserted by a third party against any of the Indemnitees arising as a result of the Promoter's use of the entrant's submission including but not limited to any breach of third party intellectual property rights.
h. Each entry must be suitable for display and publication online and should not be obscene or indecent (including but not limited to nudity, pornography, or profanity), it must not contain defamatory statements or words or symbols that are offensive either generally or to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group. It must not include threats to any person, place, business or group, it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations or network standards;
i. Any of the entry must not contain or refer to any products other than that of the specific Unilever product for Promotion and to extent applicable, it must not contain or reference any third party trademarks or logos, other than those of Unilever unless such inclusion is merely incidental and is not unduly prominent and as long as it is included with due cause and in such a way that it does not take unfair advantage of any third party trademarks.
7. Selection Process:
a. Sample requesters will be notified by email from Unilever Food Solutions immediately after completing the sample request to notify them that their business operations will receive a sample. Once the validation process is complete, the winners will receive their sample within approximately 7-10 days after closing date. If entrants fail the validation process, the sample unit will lapse and the Promoter reserves the right to offer the unclaimed sample to a substitute requester in accordance with the promotion rules.
b. Entries received in connection with this Promotion will be reviewed by the Promoter after they have been placed online to confirm that they comply with these Terms and Conditions. If any such entries/comments are or could reasonably be construed as being unlawful or offensive or contrary to these Terms and Conditions and or against any other guidelines applicable to this Promotion, we reserve the right to remove their entry from the Promotion immediately at any time without prior notice to entrants.
c. Allocation of the samples are subject to the validation of all entries by the Promoter. All valid entries received through the link on or before the closing date will be assigned a number in order of entry and the winning number will be selected accordingly. In the event of any dispute, the decision of the Promoter is final. In the event of unforeseen circumstances, the Promoter reserves the right to substitute the prize for an alternative of equal or greater value. No correspondence will be entered into.
8. The prize is as aforementioned in Clause 4, and no cash or other alternatives shall be offered. The prize is non-exchangeable, non-refundable and are not transferable. The products included within the prize will also be subject to stock/availability. The prize shall not be resold under any circumstances.
9. Data Protection: By participating in this Promotion, all entrants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Data Controller for the purposes of the administration of this promotion and any other purposes to which the entrant has consented. The personal data will be processed in accordance with the Data Controller’s Privacy Policy, which is available at https://www.unilevernotices.com/privacy-notices/united-kingdom-english.html. All entry instructions form part of the rules.
10. These Terms and Conditions and any issues or disputes which may arise out of or in connection with these TnCs (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with the English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
